Are the two sheds on the property included in the sale of the house – mentioned on MLS listing?

We’re in the process of purchasing a short sale in Rhode Island and we’ve been involved since April. We finally have the approval from the seller’s lender and have completed our inspections and appraisal. The house was occupied up until last month when the seller moved out. This past weekend she held an indoor moving sale (we know because the house was setup for it on inspection day).

I came across an ad on Craigslist advertising the moving sale and she listed the items she wanted to sell. None of it mattered to us except that she listed the two outdoor sheds for sale as well. The sheds have been on the property for years and were specifically listed on the MLS listing. We didn’t specifically mention the sheds in the offer or contract but they were implied with the “house and property to remain AS-IS”. We always assumed they had to stay since they are structures on the property and were specifically mentioned in the listing. The exact line in the MLS listing was, “2 sheds in fenced yard.”

Is she required to leave the sheds given this information or is she allowed to sell them whenever she wants? We have contacted our agent and are waiting for his call back, I’m just curious in the mean time.

If the property is listed with the sheds mentioned, yes you should expect it. You need to let your real estate agent know of your concerns. It’s the real estate agents job, along with the title company, to ensure the home is sold as it was described. Call your real estate agent immediately.
